Merafong Demarcation Forum and Others v President of the Republic of South Africa and Others

Public participation regarding altered decision on provincial boundaries

This case involved the re-arrangement of provincial boundaries to move Merafong from Gauteng to North West Province. In a minority judgment, Justice Sachs held that though Provincial and National governments were entitled to change their minds on boundary lines they had agreed upon after public consultations, if they did so, they had to have a fresh consultation with the community in the affected area.
