The Joe Slovo Residents Case

2009

Residents of Joe Slovo Community, Western Cape v Thubelisha Homes and Others

Eviction of members of a community occupying an informal settlement

This case deals with the rights of members of a community occupying the Joe Slovo Settlement next to the road to the Cape Town Airport, facing temporary eviction to allow for formal housing to be built, without guarantee of a right to return as occupiers of the new homes. In a separate judgment Justice Sachs quotes Sol Plaatjes in dealing with the history of landlessness in South Africa and its relevance to the concept of unlawful occupation.
