Writing for the Court, Justice Sachs confirmed orders of invalidity made by the High Court of sections of the Aliens Control Act of 1991 which adversely affected the rights of non-South Africans married to South Africans. In his comments he observes that the term ‘Aliens’ in itself is alienating, reducing the dignity of foreign nationals.
