This was a complicated matter dealing with the powers of a province to repeal a law dealing with rights to land. In a joint judgment Justices Goldstone, O'Regan and Sachs underline the necessity when repealing a manifestly racist law from the apartheid era, of not wiping out the limited but meaningful forms of rights of occupation that had been granted under it to marginalised communities.
